D’Angelo’s Hepatitis A Outbreak Litigation
Marler Clark’s food poisoning attorneys represented fifteen people who contracted hepatitis A after eating at D’Angelo’s in Massachusetts in claims against the restaurant. In addition to individual claims brought on behalf of people who were sickened in the outbreak, Marler Clark represented members of a class action who had eaten at the restaurant and had been exposed to the hepatitis A virus but had not become ill in a lawsuit against D’Angelo’s. In February of 2004, a judge approved the settlement of a class-action lawsuit against D’Angelo’s Deli on behalf of people who received Immune Globulin (Ig) shots to prevent hepatitis A infection during the outbreak, which took place in 2000. 1,347 Swansea residents, all class members, received $200 payments, for a total of $270,000.
Marler Clark and Sabra & Aspden donated 1/3 of their attorneys’ fees, or $15,000, to Joseph Case High School in March. Managing partner of Marler Clark, Bill Marler, said, “It’s fun to challenge people’s preconceived notions of lawyers by doing something like this,” he said. “It’s a positive thing for the school, and a positive thing for our profession.”
Two additional victims of the outbreak, who actually became ill with hepatitis A at the time of the outbreak, recently decided to pursue their related claims for compensation. Marler Clark is preparing to present their demands, and to explore the possibility of settlement before filing lawsuits.
